Who they are and what they signed

In Mexico, state prosecutors (Ministerio Público) build an investigation file (carpeta de investigación) and decide what goes before a judge. This file stems from a March 25, 2025 crash in Querencia Los Cabos; a 5-year-old girl was thrown from a golf cart. According to a statement in the investigation file, she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds).

A decision not to prosecute (no ejercicio de la acción penal) is a prosecutor's choice not to take specific conduct to court. According to the decision, dated February 11, 2026, González Beltrán proposed it as a state prosecutor (agente del Ministerio Público) with the Baja California Sur State Attorney General's Office (Procuraduría General de Justicia del Estado de Baja California Sur).

Such a decision needs a superior's approval. According to its authorization, Casimiro Morales gave it on February 13, 2026, as acting head (encargada de despacho) of the Southern Zone Regional Deputy Prosecutor's Office for Criminal Proceedings (Subprocuraduría Regional de Procedimientos Penales Zona Sur). According to its authorization, she approved "not prosecuting, because the conduct did not fit the definition of the offense" (translated from Spanish: "no ejercicio de la acción penal por atipicidad"), "on the same terms proposed" (translated from Spanish: "en los mismos términos planteados").

According to the decision and its authorization, it proposed not prosecuting, on the ground that the conduct did not fit the legal definition of the offenses (atipicidad), in favor of Querencia Real Estate, S. de R.L. de C.V., Querencia Golf Club, S. de R.L. de C.V., and the club doctor, José Luis Sánchez Musi, who is under investigation, for failure to render aid (omisión de auxilio), failure to file a medical report (omisión de informe médico) and concealment (encubrimiento). According to those documents, the same applied to the driver, who is under investigation. The same decision pursued prosecution of the driver for unintentional bodily injury and property damage.

What the complaint names

Both officials have been named in a criminal complaint filed with the authorities. According to the complaint against González Beltrán and Casimiro Morales, it concerns three alleged offenses under the Baja California Sur Criminal Code:

  • alleged unlawful exercise of public service (ejercicio ilícito del servicio público), Article 270(V);
  • alleged falsehood by public servants (falsedad de servidores públicos), Article 291;
  • alleged denial of justice (denegación de justicia), Article 308(I).

A complaint (denuncia) reports facts that may be a crime for authorities to investigate.

What the complaint alleges about the decision not to prosecute is set out in what the complaint alleges.

What the pretrial judge decided

A pretrial judge (Juez de Control) oversees investigations before any trial.

According to the transcription of the ruling, on September 23, 2026, a pretrial judge (Juez de Control) in Los Cabos revoked a prosecutor's decision not to prosecute specific offenses, dated February 11, 2026, and authorized on February 13, because it was not properly grounded or reasoned, and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting was warranted as to the companies (personas morales).

Prosecutors may issue a new, properly grounded and reasoned decision. See the pretrial judge hearings.

Article 16 of Mexico's Constitution requires every act of authority to be fundado y motivado: to cite its legal basis and explain why it applies. When a state attorney general's office advances a decision not to prosecute without meeting it, that is not due process.
