The Statement of the Driver Under Investigation in the Querencia Los Cabos Case, Set Against the Medical Records

At about 10:15 a.m. on March 25, 2025, a RAM 700 truck bearing Querencia markings rear-ended a golf cart on Boulevard Querencia, and a 5-year-old girl was thrown from it. According to a statement in the investigation file, she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds). The crash happened inside the Querencia development (Fraccionamiento Querencia), in San José del Cabo, Baja California Sur, Mexico. On March 26, 2025, the driver, who is under investigation, told a state investigator: "I got distracted for a few seconds looking down and could no longer avoid it" (translated from Spanish). Her discharge order records a Glasgow Coma Scale score of 9 on arrival, which improved to 14 after initial treatment. On July 15, 2026, state prosecutors asked a pretrial judge for a charging hearing for the driver, the club's doctor (also under investigation) and Querencia Construcciones, S. de R.L. de C.V.

What he said

This is the Querencia Los Cabos driver statement as it appears in the investigation file. On March 26, 2025, the driver, who is under investigation, told a state investigator: "I got distracted for a few seconds looking down and could no longer avoid it" (translated from Spanish: "me distraje unos segundos volteando hacia abajo y ya no pude evadirlo").

A state investigator belongs to Mexico's investigative police (Policía de Investigación). These officers question witnesses and people under investigation at the request of state prosecutors (Ministerio Público). Each interview is written up in a record called an acta de entrevista.

That record goes into the investigation file (carpeta de investigación), the body of evidence prosecutors assemble before deciding what to take to a judge. The sentence above is quoted as recorded, without comment.

What the vehicle inspections record

Records show the truck struck the golf cart from behind.

According to the inspection records, the golf cart showed impact damage at the rear. Officers examined it at 6:23 p.m. on March 25, 2025, in the club's parking lot.

The same records place the truck's damage at the front: grille, bumper, hood and front frame. That inspection is timed 12:26 p.m. on March 26, 2025.

Both examinations are described on the vehicle inspections page.

What the records show about the girl

The hospital's notice to prosecutors also documents that she was thrown from the cart. According to a statement in the investigation file, she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds).

Her discharge order records a Glasgow Coma Scale score of 9 on arrival in the trauma room, which improved to 14 after initial treatment. The Glasgow Coma Scale is a standard emergency-room measure of a patient's level of consciousness. The hospital's notice to prosecutors records significant respiratory distress, crackles in both lungs and reduced oxygen levels.

According to the medical records, she was diagnosed with pediatric polytrauma, head trauma, blunt chest trauma, pulmonary contusion and laceration, traumatic pneumatocele and a 10% laminar pneumothorax. The prognosis was guarded.

The on-duty physician at Hospital H+ Los Cabos described the injuries to a state investigator on March 25, 2025, as ones that "may put her life at risk" (translated from Spanish).

Each of the medical records is set out in the child's injuries, according to the hospital.

Where he stands in the case

When the investigation file was opened, it listed four offenses: unintentional bodily injury, failure to render aid, property damage and failure to file a medical report.

On July 15, 2026, state prosecutors went to a pretrial judge (Juez de Control), the judge who supervises the investigation stage. They requested a charging hearing (audiencia de imputación), a session where charges may be formally brought; it is not a trial.

Three parties appear in that request. One is the driver, who is under investigation. Another is the club's doctor, also under investigation. The third is Querencia Construcciones, S. de R.L. de C.V., a Mexican business form similar to a U.S. limited liability company.

More on the filing is in the request for a charging hearing.
